Acceptable Use Policy

This acceptable use policy (“AUP”) applies to your use of AINUDEZ (the “Service”) and forms part of the Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. Definition

“Digital Replica” means any image, video, audio, text, or other content that depicts, imitates, simulates, resembles, or is reasonably identifiable as a real person, including through that person’s face, body, voice, name, likeness, image, persona, distinctive appearance, or other identifying characteristics, whether exact, altered, partial, stylized, fictionalized, or AI-generated.

2. Prohibited Uses

You must use the Service only for lawful purposes and in accordance with this AUP. You must not use the Service, any input (“Input”), or any output (“Output”):

• To violate, or promote, facilitate, or contribute to a violation of, any applicable law.

• To exploit, harm, or attempt to exploit or harm minors, including by creating, generating, or distributing:

  • child sexual abuse material;

  • sexual content involving minors or persons who appear to be minors; or

  • any sexual scenario involving a non-adult person, whether real or fictional.

• To create, generate, or distribute nonconsensual sexual content, including rape, sexual assault, coercion, abuse, incest, necrophilia, or bestiality.

• To engage in, promote, or facilitate human trafficking, unlawful sexual solicitation, or sexual exploitation.

• To create, generate, simulate, or distribute any sexual Output that includes a Digital Replica of a real person without that person’s prior, documented, informed, and voluntary written consent.

• To create or distribute any Output that depicts a Digital Replica of a real person in a manner that violates that person’s rights of privacy, publicity, or other legal rights.

• To impersonate any person or misrepresent that Output depicts a real person or actual event.

• To deceive, defraud, or mislead others, including by:

  • presenting AI-generated content as real where misleading;

  • creating fake endorsements, testimonials, or advertisements; or

  • generating deceptive commercial or promotional content.

• To infringe or misappropriate any intellectual property or other rights of any person.

• To collect, process, or use personal data in violation of applicable law.

• To advertise or promote goods or services without our prior written approval.

• To use the Service in any manner that violates or attempts to circumvent payment processor or card network rules, including requirements relating to age verification, consent, recordkeeping, and prohibited content.

• To bypass, evade, or interfere with any safeguards, filters, or moderation systems of the Service, including through prompt manipulation, obfuscation, or iterative attempts to generate prohibited Output.

• To interfere with or disrupt the Service or any related systems, including by transmitting malware or attempting unauthorized access.

3. Content Standards

You must not submit Input or generate Output that:

• Violates applicable law.

• Depicts, promotes, or facilitates exploitation or abuse of minors.

• Depicts or promotes nonconsensual, coercive, or exploitative sexual conduct.

• Depicts incest, necrophilia, bestiality, or extreme sexual violence.

• Is obscene or otherwise unlawful under applicable law.

• Includes a Digital Replica of a real person in a sexual context without required consent.

• Violates the rights of privacy, publicity, or intellectual property of any person.

• Is fraudulent, misleading, or deceptive.

• Promotes or facilitates violence, threats, harassment, or abuse.

• Contains malicious code or harmful technology.

4. User Responsibilities

You are solely responsible for your Input and use of the Service.

You must:

• Obtain all rights, permissions, and consents necessary for your Input and use of any Output.

• Obtain prior, documented, informed, and voluntary written consent before creating any Output involving a Digital Replica where required.

• Maintain any legally required records relating to age verification, consent, and related compliance obligations.

• Comply with all applicable laws and payment processor or card network requirements.

• Clearly disclose when Output is AI-generated where required by law or where failure to do so would be misleading.

5. Monitoring and Enforcement

We may monitor use of the Service to ensure compliance with this AUP.

A violation of this AUP constitutes a material breach of the Terms of Service. We may, with or without notice:

• remove or restrict access to any Input or Output;

• suspend or terminate your access to the Service;

• refuse to generate or regenerate Output;

• report unlawful conduct to law enforcement or appropriate authorities; and

• take any action we deem necessary to protect the Service or comply with legal or commercial obligations.

We may remove or restrict content that creates legal, regulatory, or payment processor risk, even if not expressly prohibited by this AUP.

6. Changes to this AUP

We may update this AUP from time to time. Changes are effective upon posting. Your continued use of the Service constitutes acceptance of the updated AUP.
